22 year old, Damien McGuiness, an Irish citizen, has been charged with one count of rape in the first degree; bail has been set at $5,000.
McGuiness, a Midtown bartender, allegedly took advantage of a woman at an apartment early Thursday around 4:45 am, near Columbia University.
The woman who is from out of town was visiting a friend in New York. She went out out for drinks with her friend when they met McGuiness and his friend, Brian Duddy at a bar. Later that night the group went to the apartment.
“What started as a consensual encounter between the defendant’s friend and the complaining witness ended with the defendant raping the complaining witness,” Assistant District Attorney John Temple said at his criminal court arraignment Friday.
McGuiness and Duddy were apprehended on the subway after the alleged victim promptly reported the incident too 911.
McGuiness may not be able to post the bail. His court appointed attorney, Brad Sage, said McGuiness is originally from Northern Ireland where he was a college student before coming to New York and been working as a bartender in a Midtown.
Sage said McGuiness lost his passport and license about a week ago. He must appear again in court on Aug. 16 and either report his documents as missing or find them and surrender them if he makes bail.
McGuiness’s friend, Duddy, was arrested, and released – no charges were filed. Duddy told police “anything that transpired was consensual.”
